CWind Training Terms & Conditions

By booking with CWind Training for any of our training courses, you are agreeing to our terms and conditions:

Payment Terms
Payment (or valid purchase order) is required prior to the course start date to secure a booking. Late payment will result in your certificates being withheld. These will be issued once payment/PO has been received. To make a payment using a credit or debit card, please call 01245 703 000.

Cancelling your Booking
Notice of cancellation of a booking must be given in writing and no less than 14 working days before the course start date to receive a full refund.

100% of the course fee is payable when notice of cancellation is received less than 14 days before the start of the course.

On the Day
Participants should arrive 15 minutes before the scheduled start time, in order to register. Trainers reserve the right to turn away delegates who arrive late. You will not be offered a refund and will need to pay to attend another date.

Medical and ID
To attend any of our courses you must have a current medical certificate and be at least 18 years old.
You must be able to provide CWind Training with documents as proof of this. If you are unable to provide these documents, you will be at risk of being turned away on the day and unable to attend the course. You will not be offered a refund. Copies can be emailed as proof to TrainingInfo@cwind.global. If you are unable to provide proof before your course date, it is an option to take your documents with you on the actual course date, but you must have informed CWind Training beforehand, as our trainers need confirmation from us that you are eligible to take part in the course. The trainers reserve the right to turn away delegates if they have reason to believe the delegate is unfit to participate in any part of the training. You will not be offered a refund.

Unacceptable Behaviour 

CWind Training is committed to the fair and equal treatment of all employees and delegates. Bullying, harassment, victimisation and discrimination in any form are unacceptable. Any delegate seen to be acting under this pretence will be asked to leave the course and no refund will be given. If you believe the issue is with the trainer, you must contact the CWind Training office immediately to discuss the matter and appropriate action will be taken.
Any form of violence, actual or perceived will be treated in the same way and the delegate will be immediately removed from the course and no refund will be given.
Anyone perceived to be under the influence of drugs or alcohol will be asked to leave the premises, may be reported to the police and no refund will be given.

CWind Training reserves the right to withdraw any delegate from training at any time if they believe the safety or security of the course is being compromised by that individual.

Liability
As with other training of this type, some activities contain an element of risk, and participation in these activities is your decision and at your risk. CWind does not accept any liability for loss or damage to any property of any course participant or any liability for personal injury or death that may occur during the course.
All services and reports are provided for our Clients’ use only. No liability of whatever nature is assumed towards any other party and nothing in these terms, or the relationship between us and our Clients, shall confer or purport to confer on any third party a benefit or the right to enforce any provision of these terms.

Health and Safety
All delegates are reminded that training courses are considered as “at work” in as far as legislation is concerned, and that they are still subject to the general conditions of employment applied by their companies. They should conduct themselves during practical work with respect for the health and safety of themselves and others. Safety instruction from staff, tutors, consultants and demonstrators must be rigorously observed.

Alcohol and Drugs
Alcohol and/or drugs are totally prohibited. The trainers reserve the right to turn away delegates if they have reason to believe the delegate is under the influence of alcohol and/or drugs, or otherwise unfit to participate in any part of the training. You will not be offered a refund.

Law and Disputes
These terms shall be governed by and construed in accordance with English law. Any dispute or difference arising, or claim made, between or by the parties out of or in relation to or in connection with the provision of services to which these terms relate and which cannot be resolved by the parties shall be submitted to the non-exclusive jurisdiction of the High Court of England and Wales.

Force Majeure
We cannot accept responsibility or pay compensation where we are forced to change or cancel your course due to Force Majeure (war or threat of war, riot, civil strife, terrorist activity, industrial dispute, unavoidable technical problems with transport, closure or congestion of airports, natural or nuclear disaster, fire, epidemic, terrorist activity, civil unrest, change to Foreign Office advice to advise against travel to destination, adverse weather conditions (actual or threatened) or similar events beyond our control. Once your course has started we will not be liable for any loss, delay, inconvenience or extra expenses caused to you for any reason beyond our control.

Assessment
Assessment of all theory and practical courses delivered by CWind Training will be assessed by a trainer deemed competent based upon specific criteria.

Type of assessment
This course will be based upon a three tier assessment strategy; this involves the following assessment processes.
1. Trainer observations during the course, on-going assessment by the trainer of the delegate’s overall performance.
2. Key assessment criteria demonstrated – there are key criteria that need to be met for the delegate to pass the course, this is will be clearly explained to all delegates on the day.
3. Theory assessment – An end of course test consolidating and evidencing all learning will vary depending on course.

NB: This course is not attendance based and successful completion of all modules is required in order to pass.

Pass / Deferral
CWind Trainings aim is for all delegates to pass the course they attend, we do this by observing strict trainer-delegate ratios and using experienced trainers. However, if the trainer feels the delegate is falling short of course standards, they will identify issues with the individual and support them through the course. If there is no improvement the delegate will be deferred from the course with an agreed action plan written by the trainer for future guidance.
The delegate will be advised whether they have passed or deferred on the last day of the course. If the delegate is deferred, a conversation between trainer and delegate will take place as soon as the trainer identifies this. This decision will be made by the trainer/assessor and will be based upon the three tier assessment strategy.

NB: If the delegate is deferred from the course due to attitude, fitness or an inability to meet the required standards; the full course fee is non-refundable.

Certification
On successful completion of your course a GWO CWind Training certificate is emailed, within 5 working days, to the individual or company that booked your course. We will also update your course details on the WINDA database – This can take up to 2 weeks from the course completion date. If any certificate details are incorrect, please contact traininginfo@cwind.global

NB: To avoid confusion, certificates will be automatically sent to the person or organisation who books and pays for the course. If you have any issues receiving copies, you must raise this with the booker.
